The purpose of these General Terms and Conditions (‘GTC’) is to establish a legal framework for the relationship between the accommodation provider and the client, ensuring the client is informed about the conditions of service provision.

These GTC become binding for the provider upon their publication and for the client upon ordering a service.

I. Definitions

Client – a natural or legal person who enters into a service agreement with the provider or submits a binding order.
Provider – the accommodation facility operated by VILA GARUFA, s. r. o., registered office: Rastislavova 3468/34, 058 01 Poprad, Slovakia, registered in the Commercial Register of the District Court Prešov, section: Sro, file no. 43409/P, Company ID: 54 314 364, Tax ID: 2121631974, VAT ID: SK2121631974. Premises: Stará Lesná 18, 059 60 Vysoké Tatry.
Service – accommodation services and related services (wellness, dining).

II. Contract Formation

The contract is formed upon confirmation of the client’s order (reservation) by the provider. Confirmation may be made in writing, by email or through the booking system.
By entering into the contract, the provider undertakes to provide the client with services of the agreed scope and quality, and the client is obliged to pay the agreed price.
The client is required to provide truthful and complete personal information.

III. Accommodation Services

The provider shall make the reserved accommodation available to the client from the agreed check-in time. The client is not entitled to a specific room unless specifically agreed with the provider.
The client must vacate the accommodation by the agreed check-out time on the day of departure.
The client is obliged to report any deficiencies or damage immediately upon discovery.

IV. Pricing and Payment Terms

The client is obliged to pay the agreed price for the services provided, as stated in the booking confirmation.
Prices are quoted in EUR inclusive of VAT. Local taxes and fees may be charged separately.
The provider is entitled to request an advance payment upon contract formation. Deposit terms are specified in the booking confirmation.
Payment is accepted by cash, credit/debit card or bank transfer.

V. Cancellation Policy

The client has the right to cancel the booked accommodation.
Cancellation terms and fees are specified in the booking confirmation and depend on the selected rate type.
Cancellations must be submitted in writing by email to rezervacie@vilagarufa.sk. The cancellation date is the date of receipt of the written notice.

VI. Client Rights and Obligations

The client is obliged to comply with the house rules, with which they are informed upon arrival.
Smoking is strictly prohibited throughout the premises.
Pets are permitted only by prior arrangement with the provider.
During quiet hours (22:00–07:00), clients must behave so as not to disturb other guests.
The client is liable for any damage caused to the property.
The client must present a valid identity document upon arrival for mandatory guest registration.

VII. Provider’s Liability

The provider is not liable for damage to items left outside designated storage areas.
Valuables are only covered if formally entrusted for safekeeping.
The provider accepts no liability for service interruptions caused by force majeure.

VIII. Complaints

Any deficiencies must be reported immediately during the stay.
Complaints submitted after departure may not be considered.
Complaints will be resolved within 30 days from the date of filing.
Complaints are governed by the applicable provisions of Slovak consumer protection legislation.

IX. Final Provisions

These GTC are governed by the laws of the Slovak Republic.
Consumers have the right to alternative dispute resolution through the Slovak Trade Inspection (www.soi.sk) or the EU ODR platform (ec.europa.eu/consumers/odr).
The provider reserves the right to amend these GTC. The current version is always available on the provider’s website.

These terms and conditions are effective from 1 January 2024.
